copyright infringement?

Hello from CANADA ::tippinghat::

I had written a post in response to a poster's statement using some passages from a book that was copyrighted 1996 and 2007.  After I posted it I read this in the inside cover of the book:All rights reserved.  No part of this publication may be produced , stored in a retrieval system, or transmitted in any form by any means--electronic, mechanical, digital, photocopy, recording, or any other--except for brief quotations in printed reviews, without the prior permission of the publisher.

Much to my disappointment, I thought I had better delete my post which I did.
Are we allowed to quote from books if we mention who writes it and who publishes it?  Or are we breaking the law if we quote passages from a published source?

I did not want to remove my post but since I was not sure I gave it the boot.  What is allowed for us? Could we get in trouble for posting someone's written work?

Anyway, will you please answer here?  And thanks for everything.

The US copyright law allows for the "unauthorized" duplication of copyrighted works; it's called "fair use."  Basically, it must be a short excerpt that does not comprise either a large portion of the cited work, or a large portion of the work in which they are excerpted.  (What constitutes "large" or "small" is very subjective.)  Kinda complicated, but u can look it up online.

As for international matters...good question.  I only deal with American books in American forums.  Someone out there must know.

It is always best to get permission from the copyright holder.  When in doubt, get permission, first.  You were correct to delete it.

I am a writer, myself and I never post anything that is someone elses unless they have given me permission first or it is in public domain, or they say it is free to share.  In each case, however, one should mention one of the above next to the posted work....

Hi Steve...the book is by an American author, the publisher is American and this website is American. 
I had chosen some passages that would be about 1 1/3 pages more or less.
But nonetheless, does anyone have anything else to add here?  Thanks.

fwiw, here's what the rules say:

Quote4.1 You will not post, attach, use or send any posts, PMs, links, images or files:
....
c. that violate or promote the violation of local or international laws and regulations (including the posting of any copyright material such as songs, movies or text). All quoted articles from external sources such as news articles must not be more than 10% of the original article to be legal or else copyright is infringed. A link must be provided to all quoted material. The only exception is quotes for AP (Associated Press) articles which are limited to one sentence only or where permission by the author is granted for reproduction in full with the permission statement.


istm that what you're talking about would be fair use, but I'm not an expert.

Actually the book is The Gay Gospel? How Pro-Gay Advocates Misread the Bible by Joe Dallas  I love this book of his and dearly wish every church library had a copy.  I think it's an outstanding piece of writing on such a sensitive topic.
I was thinking of actually getting in touch with Joe Dallas.  I think I definitely will now and I'm sure he'll let me know what's what!

Anyway, thanks again.  I appreciate your input here.

Oh, you need to get permission first.  Especially if it is that long.  You could get yourself in big trouble.  I would not risk it if I were you....  It is the law....

I did not see your above post before I posted my warning.  Most authors are delighted to have their work appreciated.  And I think it's great you want to get in touch with him.  But, for duplication purposes, it would be up to the copyright holder.

Thanks Marc and ConqueredbyLove.  As always much appreciated.
I think I will try to get in touch with the author.  Believe me, we have lots in common.  

I have a real heart's desire to hear him speak in person.  If that is something God wills then that will happen.  If it does not, then I'll be content to hear from him by post or e-mail.  I'll have to look into what educational materials he has to offer.
